Join us for an overview and update regarding third party rights to contracts in Scotland, with a particular focus on construction law and related case law.

Katherine Doran and Jonathan Gaskell, both partners from DWF, will discuss the key updates to this area of law since the implementation of the Contract (Third Party Rights) (Scotland) Act 2017. Beginning with a consideration of collateral warranties, conversation will also cover the Engine Yard Edinburgh Limited and Allenbuild Limited v Bayne Steven Associates limited, and Abbey Healthcare (Mill Hill) Ltd v Augusta 2008 LLP (formerly Simply Construct (UK) LLP) cases with the alternative of third-party rights being the final point of discussion. The session will include ample time for questions and discussions with speakers and colleagues.

Learning Outcomes

  • Gain insight into the evolution of the Contract (Third Party Rights) (Scotland) Act 2017
  • Discuss the updates to third party rights created through case law such as Engine Yard Edinburgh and Abbey Healthcare cases
  • Compare and contrast collateral warranties with third party contractual rights
  • Learn key insights into this area of construction and contract law to provide current and relevant advice to clients
