Our expert speaker will take the time to explore what litigation means specifically for AWI and guardianship cases, and provide industry insights into how these instances can be handled to cause the least amount of disruption to clients.

Analysis will include common reasons for why litigation occurs, the step-by-step process for removing or varying a guardian or attorney, and action to be taken if abuse, negligence or coercive behaviour is taking place. They will deep dive into preventative measures to keep litigation from occurring, safeguards to assist the elderly or cognitively impaired client, and best practice in litigation if a client is incapacitated to ensure that you feel equipped to handle litigation if it arises in your AWI and guardianship cases.

Learning Outcomes:

  • Analyse when litigation becomes necessary in cases of AWI and guardianship, and preventative measures that can be taken to try and prevent its occurrence

  • Learn best practice when removing or varying a guardian or attorney, and for litigation in general, when a client is incapacitated or cognitively impaired
