Join us in February to take stock of the latest proposals to change the law surrounding private residential tenancies in Scotland. This webinar is for all legal professionals working in residential property.
In the ongoing housing crisis, fewer people can afford to own their own property. Additionally, the cost of rent is rising, prompting calls for rent control. This webinar will look at the law protecting those in private residential tenancies and consider whether further protections are needed to strengthen the rights of tenants in Scotland. Furthermore, we will consider how rent control would function in practice, and the impact that this could have on your clients.
Learning outcomes
- Understand the current legal protections benefiting tenants in Scotland, and how these protections could change with incoming legislation
- Gain perspective on the measures proposed in England and Wales, and how this might impact the level of protection awarded to renters across the United Kingdom
- Consider the best practice for landlords in the event that the proposed legislation is successful

12:05 Tenants’ Rights
- What rights do tenants currently hold in Scotland? Which laws protect these rights?
- How might the Housing (Scotland) Bill and the Renters’ Rights Bill strengthen the rights of tenants in Scotland?
- Will these two bills align the protection of tenants’ rights in Scotland with England and Wales? Do any notable gaps exist?
12:35 Rent Controls
- What rent controls are proposed by the Housing (Scotland) Bill?
- Under the current proposals, which areas are likely to be designated as “rent control areas”?
- In the absence of any other rent control measures, should the Rent Adjudication scheme from the Cost of Living (Tenant Protection) (Scotland) Act 2022 continue beyond March 2025?
