The 20th of January saw the remaining provisions of The Bankruptcy and Diligence (Scotland) Act 2024 come into force. In this hour-long webinar we will provide an in-depth overview of these new provisions and what they mean for you and your clients.

Our expert speaker, Ahsan Mustafa, Associate Solicitor at Aberdein Considine, will consider the ways in which Scottish laws on bankruptcy and diligence have unaligned with those of England and Wales, and the changes that have been introduced to ensure a consistent approach across both jurisdictions. The discussion will focus on the new mental health moratorium, modifications to the Bankruptcy (Scotland) Act 2016, and the modernisation of debt recovery mechanisms. Ample time will be provided to discuss topics with our speaker and fellow colleagues.

Learning Outcomes:

  • Gain an up to date understanding of the new provisions of The Bankruptcy and Diligence (Scotland) Act 2024
  • Learn how Scotland’s laws for bankruptcy varied from those of England and Wales and why changes were necessary
  • Deep dive into mental health moratoriums and modifications made to the Bankruptcy (Scotland) Act 2016
