It is not uncommon for the succession laws of Scotland and England & Wales to come into conflict with one another. A deceased may have written their will in England only to pass in Scotland, or their family may reside in Scotland while they were in England. This one-hour webinar will be dedicated to untangling these laws, analysing their differences and solidifying which laws are to be used in which contexts.

We will discuss the many divergences in succession law including confirmation vs probation, the significance of presumption of testamentary freedom and the impact of forced heirship, legal rights, divorce and capacity. Real life examples will be utilised to determine which country’s laws take precedent in particular contexts. Time will also be allotted for discussion with the speaker and colleagues.

Learning Outcomes:

  • Learn the key differences between Scottish and English succession law
  • Gain insight into the different circumstances where one country’s succession laws will take precedence over the other and the impact of specific circumstances such as a divorce or loss of capacity
  • Discover how best to advise your clients no matter the cross-border considerations of their situation
