Scottish Solicitors’ Discipline Tribunal
Paul Robert Anderson
A Complaint dated 30th August 2001 was made by the Council of the Law Society of Scotland against Paul Robert Anderson, Solicitor, sometime of 2 Lindsay Court, Technology Park, Dundee, and his last known address was Millbank, Perth Road, Abernethy, Perthshire (“the Respondent”).
At the Hearing on 7th November 2001 the Tribunal found that the Respondent had failed to comply with the Determination and Direction given by the Council of the Law Society under Section 42A of the Solicitors (Scotland) Act 1980 whereby the Respondent was to reimburse clients in the sum of £952.31 and pay them the sum of £100 by way of compensation. The Tribunal found that the Respondent had failed to comply with the Determination and Direction within the period specified and made an Order in terms of Section 53C(2) of the said Act, which Order shall be enforceable in like manner as an extract registered decree arbitral in favour of the Council of the Law Society of Scotland.
Donald Stewart Duncan
A complaint dated 1st June 2001 was made by the Council of the Law Society of Scotland against Donald Stewart Duncan, Solicitor, of Sit-Ma-Lain, Bowriefield by Forfar (“the Respondent”).
At the Hearing on 12th September 2001 the Tribunal found that the Respondent had failed to comply with the Direction given by the Council of the Law Society under Section 42A of the Solicitors (Scotland) Act 1980 to the effect that the fees charged by the Respondent in relation to an executry should be restricted by £600. The Tribunal found that the Respondent had failed to comply with the Direction given by the Council of the Law Society within the specified period and made an order in terms of Section 53C(2) of the said Act directing that the said sum of £600 be paid and that the Order be enforceable in like manner as an extract registered decree arbitral in favour of the Council of the Law Society of Scotland.
