Roundup of developments at the Public Guardian, who is now also on Twitter
The Public Guardian is now on Twitter (@OPGScotland) and will be using this medium for news and changes to practice.
- The OPG has issued a reminder that for it to be satisfied that a capacity certificate has been “incorporated” in the PoA document in terms of ss 15 and 16(3)(c) of the 2000 Act, all PoA documents must be dated alongside the granter’s signature. This date must correspond with that entered in the certificate.
- For the past four months the OPG has been working with new processes asking solicitors to complete a contact information form for prospective financial guardians, which provides an early opportunity to ensure they are aware of what is involved and what will be expected of them. It would be appreciated if the form is submitted along with the court papers.
- As of 1 February 2016 Zurich Surety will no longer provide new bonds of caution; it will renew bonds due before that date for one year but not thereafter; bonds due for renewal after that date will not be renewed. This applies to both guardianship and judicial factory bonds. The OPG has an information leaflet on alternative providers.
- The parameters for the simplified account have been changed: the value of estate has increased to £20,000, based solely on the adult’s moveable estate.
