Styles agreed for confirmation declarations
Following the changes that were introduced to confirmation applications by the Succession (Scotland) Act 2016, the Trusts & Succession Subcommittee of the Law Society of Scotland, along with the Scottish Courts & Tribunals Service, have agreed style declarations in applications for confirmation.
Applications for confirmation nominate, other than those where a professional body is appointed, need to include a declaration setting out the relationship between the deceased and the applicant. The court requires to be satisfied as to the extent of the relationship between the deceased and the executor. In particular, the court is concerned with whether the deceased was ever married to or in a civil partnership with the deceased.
