Tolerable standard will require smoke and CO alarms
The Housing (Scotland) Act 1987 (Tolerable Standard) (Extension of Criteria) Order 2019 extends the criteria set out in the Housing (Scotland) Act 1987, s 86(1) by adding new requirements for houses to have satisfactory fire detection alarms and carbon monoxide detection alarms. There is a two year window for properties to be brought up to standard before the requirements come into force on 1 February 2021.
The policy intention, supported by responses to the Fire and Smoke Alarm Consultation in 2017, is to have a common new minimum standard for fire and smoke detectors across all housing, regardless of whether the house is owner-occupied or rented in the social or private sector. The new standard is based on the standard currently applying to private rented property.
