Arbitration Act opt-out to end at new year, ministers propose
People going to arbitration in Scotland will no longer have a choice of legal regimes after the end of this year, Scottish ministers propose.
A consultation has opened on a draft order ending the transitional provision in s 36(3) of the Arbitration (Scotland) Act 2010, under which arbitrating parties could contract out of the 2010 Act scheme in favour of the previous arbitration law.
The consultation, which runs for a shortened period of 10 weeks, is targeted towards those with an interest or involvement in arbitration, as provided in the Act. It also takes account of the time required for consideration of the draft order by the Scottish Parliament, ahead of the intended commencement on 1 January 2017.
