Commission seeks views on Contract Formation Bill draft
A working draft of a bill on the formation of contracts has been published by the Scottish Law Commission.
The Commission is consulting on the proposed terms of a new law prior to publishing a final draft bill on formation along with its final report (on formation, interpretation, penalty clauses and remedies for breach) in 2018.
Areas on which the Commission would particularly welcome views, according to a covering note published with the draft, are provisions on when notification (including electronic communication) to the other contracting party takes effect; abolition of the rule regarding notification of postal acceptance; revocation of offers; lapsing of offers on material change of circumstances; conculsion of contract by unnotified acts; and counter offers.
