Faculty keen on new third party rights law
“Enthusiastic support” for the proposed bill restating the law on third party rights in contract has been offered by the Faculty of Advocates.
In its response to the Scottish Government, which asked for views on a bill to implement law reform proposals of the Scottish Law Commission, Faculty considers that codifying and clarifying the common law of ius quaesitum tertio in modern language "will be an important improvement for Scots contract law".
Its response goes on to offer a number of comments on the drafting of the Bill, which it suggests could be simplified and clarified in certain respects.
