Is simple procedure working, SCJC asks?
Users of the new simple procedure in the sheriff court are being asked for their views on how the procedure in working, in a consultation opened today.
The Scottish Civil Justice Council is carrying out the exercise as part of its review of the procedure rules are working. The consultation will run until 31 May 2018.
Simple procedure was introduced in November, 2016 as process to enable people to resolve civil disputes in an informal, speedy and inexpensive way, including by conducting their own case. The rules are laid out using accessible language and user-friendly guidance wherever practicable.
The consultation questions are exopressed in general terms, seeking comments on making and responding to claims, or making applications, using the procedure, and the forms involved, as well as on documents, evidence or witnesses.
