New guidance issued on deprivation of liberty
The Mental Welfare Commission for Scotland has published updated analysis and guidance on the deprivation of liberty. The guidance considers the right to liberty in the context of the care and treatment of adults with mental illness (including dementia), learning disabilities and other related conditions in Scotland.
It takes into account several significant recent cases, including European Court of Human Right’s ruling in Bournewood, and UK Supreme Court’s March 2104 ruling in Cheshire West.
