Questions for Scottish Court Service
The Scottish Court Service has come in for criticism after posting in full on its website offensive material.
The material came from a judgment over whether a man sentenced for posting sick jokes online should have been placed on the sex offenders register.
The material was considered so offensive that the public were asked to leave the courtroom when they were read out.
The sheriff who sentenced him for the crime, an offence under the Communications Act, placed him on the register, but appeal court judges overruled the decision, claiming that posting sick jokes does not make someone a danger to the public.
Law Professor James Chalmers, of Glasgow University, told the Herald newspaper: "The odd thing about this is that you have these jokes which someone has been prosecuted for after posting on Facebook and here you have the court posting the same things on its website. It's a bit odd.”
