Scottish Charity Appeals Panel to become a Scottish tribunal
Draft regulations transferring the Scottish Charity Appeals Panel (SCAP) to the Scottish Tribunals have been put out to consultation by the Scottish Government.
The functions and members of SCAP will transfer into the Scottish Tribunals system on 30 November 2017, becoming part of the General Regulatory Chamber. The SCAP as it presently stands will then be abolished.
Four sets of draft regulations have been produced, providing for the transfer the functions and members of the SCAP to the Scottish Tribunals, the rules of procedure for the First-tier Tribunal for Scotland General Regulatory Chamber, the composition of the First-tier and Upper Tribunals for Scotland and eligibility for ordinary membership of the chamber.
All existing members of SCAP will transfer into the Scottish Tribunals as long as they meet the eligibility criteria and have not reached the upper age limit. Chairs of SCAP will transfer in as legal members of the First-tier Tribunal. Other members of the SCAP will transfer in as ordinary members of the First-tier Tribunal with allocation to the General Regulatory Chamber.
