Interim agreement supporting case progess in C19
Experienced Personal Injury practitioners have been working together to produce a ‘ways of working’ agreement to support progress in cases which might otherwise be stalled as a result of the coronavirus outbreak.
The Law Society of Scotland Courts Working Group support the agreement, which ensures a cohesive approach to the issues affecting the profession and their clients as a result of the pandemic.
While the reopening of the courts is clearly a positive development, there is a backlog of cases to be processed and new cases will not be dealt with as per the normal process and timescales.
The delays are particularly prevalent in the Personal Injury (PI) courts, and consequently PI Pursuer and Defender practitioners have put together an agreement to compliment the Court procedure. The agreement is intended to enable parties to either resolve their cases or enter the court process at a more advanced stage. The agreement has been produced as a voluntary and temporary measure until the backlog is cleared.
