Taxation by teleconferencing
The Law Society’s Civil Working Group, following discussions with Scottish Courts and Tribunal Services (SCTS), has received confirmation that the Auditor of the Court of Session and the All Scotland Sheriff Personal Injury Court (ASSPIC) will now conduct taxations of judicial accounts by way of tele-conference.
Taxations had been on hold unless parties agreed to have them conducted by way of written submission. It was open for one party to object and in that event no progress could be made.
The move to conduct taxations by telephone is mandatory unless all parties opt to proceed by way of written submissions and is a welcome development for those who have been unable to progress the recovery of expenses awards.
