SCJC approves medical and disease pre-action protocols
New pre-action protocols ("PAPs") for disease and clinical negligence cases have been approved by the Scottish Civil Justice Council, which has remitted them to its Costs & Funding Committee to oversee the development of suitable fees structures.
These PAPs follow the committee's previous work which resulted in the Council implementing a PAP for personal injury actions. A working group of individuals with suitable expertise has been set up to develop the underpinning policy for the fees regimes. It includes some who have worked on development of the PAPs.
It will submit proposals to the Costs & Funding Committee in due course.
