"Successful and eventful" 2022: SLC annual report
A "successful and eventful year" has been recorded by the Scottish Law Commission in its annual report for 2022, published today.
The year saw the publication of three reports, on aspects of the termination of leases, on cohabitation, and the joint report with the Law Commission for England & Wales on automated vehicles, along with a discussion paper on the law of damages for personal injury. Since the end of the year the joint report on surrogacy has also been published.
Bills were introduced in the Scottish Parliament to implement the reports on moveable transactions and on trusts and succession. The Commission states that 82% of the reports it has published over its life have been implemented in whole or in part, with 3% superseded and the other 15% awaiting action.
From its current projects, it hopes to publish a report and draft bill on homicide, and one on damages for personal injury, before the end of 2023. A discussion paper on compulsory owners' associations for tenement properties is also forecast.
Chair of the Commission, Lady Paton said: “The past year has been a productive one for the Commission on a number of different fronts. We continue to work on our law reform projects; three reports were published. We consulted on topics for our next programme of law reform, which we aim to publish shortly. We are grateful for all the suggestions received. As we continue to emerge from the shadow of the pandemic, we have developed our online and in-person outreach and consultations. We are pleased to be supporting two SLC bills in the Scottish Parliament which will implement our recommendations.”
